KickOff Social Football App

Welcome to KickOff ("the App", "we", "us", "our"). KickOff is a social football application that enables users to organise, discover, and join casual football matches in their local area. By downloading, accessing, or using the App, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use the App.

1. Introduction

The App is owned and operated by Kick Off App Ltd, a private company limited by shares, incorporated in England and Wales (Company Number: 17291462). The company's registered office is at Unit 18, Park Royal Business Centre, 9-17 Park Royal Road, London, England, NW10 7LQ. The directors of the company are Jason Dias and Sagar Amliwala. The App is available on iOS via the Apple App Store.

2. Definitions

"Company" means Kick Off App Ltd (Company Number: 17291462).

"User" means any individual who creates an account and uses the App.

"Booker" means a User who creates and organises a football match through the App.

"Match" means a football game listed on the App with a fixed date, time, and venue.

"Group" means a collection of Users who regularly play together and share match history.

"Credits" means the in-app balance issued to a User, denominated in GBP, that can be used towards future match payments.

"Plus-One" means an unregistered guest added to a Match by a registered User on their behalf.

"Username" means the handle or display name chosen by a User to identify their account within the App.

3. Eligibility

You must be at least 16 years of age to create an account and use the App. We ask for your date of birth when you register, and it cannot be changed afterwards. By registering, you confirm that the information you provide is accurate.

Some parts of the App require you to be 18 or over:

If you are under 18, you confirm that your parent or guardian is aware you use the App. If you are 18 or over, you confirm you are legally capable of entering into binding agreements under the laws of England and Wales; if you are 16 or 17, your parent or guardian enters into these Terms on your behalf.

4. Account Registration

To use the App, you must create an account using a valid email address and complete a skills questionnaire. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

5. Usernames, Handles, and Impersonation

When you register, you choose a Username that identifies you to other Users. The following terms govern your use of Usernames within the App.

5.1 Licence, not ownership. Your Username is licensed to you for use within the App while your account remains active. You do not own your Username and acquire no proprietary, trademark, or other intellectual property rights in it. We may reclaim, reassign, alter, or require you to change your Username at any time at our reasonable discretion.

5.2 Choosing a Username. You must not select, register, or use a Username that:

5.3 Reserved names. We reserve certain Usernames, including those associated with the Company, its staff, generic administrative terms, and the names of well-known individuals, teams, and brands. We may withhold, disable, or refuse the registration of any such Username.

5.4 Verification. Where a Username corresponds to a real person, public figure, team, or brand, we may require you to provide reasonable proof of your identity, or of your authority to use that name, before permitting its continued use.

5.5 Complaints and reclamation. If we receive a credible complaint that a Username infringes another person's rights, impersonates another person, or otherwise breaches these Terms, or if a Username has been inactive for a prolonged period, we may, at our reasonable discretion and without liability to you: (a) suspend or disable the Username; (b) reclaim it and require you to select a new one; or (c) rename the account, for example by appending characters. Where practicable, we will notify you of any such action.

5.6 Reporting. If you believe a Username infringes your rights or those of a third party, or impersonates you or another person, please contact us at hello@kickoffsocialapp.co.uk with relevant details. We will review reports and take such action as we consider appropriate.

5.7 No liability for changes. We are not liable to you for any loss arising from the reclamation, suspension, alteration, or reassignment of a Username in accordance with these Terms.

7. Payments and Pricing

Match payments are processed securely through Stripe (Stripe Payments Europe, Ltd.), a PCI-DSS Level 1 certified third-party payment processor. Kick Off App Ltd does not store, process, or have access to your full payment card details at any time. All payment information is handled directly by Stripe in accordance with their own terms of service and privacy policy.

Kick Off App Ltd uses Stripe Connect to facilitate payments between Users and Bookers. When you pay to join a Match, your payment is processed by Stripe and the funds are transferred to the Booker via their connected Stripe Express account. Kick Off App Ltd acts as the platform facilitating the connection between Users and Bookers through Stripe Connect; the Company does not act as a payment institution or e-money issuer.

The total cost per player (including any applicable platform fees) is displayed clearly before you confirm your payment, in compliance with the Consumer Rights Act 2015. Prices are displayed in British Pounds Sterling (GBP). Accepted payment methods include debit cards, credit cards, Apple Pay, and Google Pay, as supported by Stripe. By making a payment through the App, you also agree to Stripe's Terms of Service (https://stripe.com/legal) and Privacy Policy (https://stripe.com/privacy).

8. Refunds, Cancellations, and Credits

Football matches organised through KickOff are leisure services provided on a specific, fixed date. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (Regulation 28(1)(h)), services related to leisure activities provided on a specific date are exempt from the 14-day cooling-off period that ordinarily applies to distance contracts. How a payment is returned depends on the reason for the cancellation:

Refund to your original payment method. Where a paid game does not take place through no fault of yours, the amount you paid is refunded to the original payment method used. This applies when: the organiser cancels the game; the organiser fails to start the game or does not attend; the game is automatically cancelled by the App; or the organiser materially changes the time, price, or team size of a Discover game and you do not re-confirm your place. Such refunds are processed through Stripe and may take several days to reach your account, depending on your bank or card provider.

Refund to in-app Credits. Where you voluntarily withdraw from a game that still goes ahead, any amount you paid is returned to your in-app Credit balance (denominated in GBP), which can be applied to any future game. Credits are not automatically returned to your original payment method, but may be withdrawn on request as set out below. Credits do not expire while your account remains active. When those Credits are issued depends on how much notice you give:

Rejoining a game you have left. If you withdrew 2 hours or less before kick-off and your payment is still being held, you may rejoin the same game at no further charge for as long as a place remains and nobody else has taken yours. If you withdrew earlier than that, you were refunded to Credits at the time, and rejoining is a fresh booking which you may pay for using those Credits.

Guests and Plus-Ones. Where you pay for one or more guests in the same transaction as your own place, each place is treated separately for the purposes of this section, on the same timings set out above.

Withdrawing unspent Credits. You may request the return of unspent Credits at any time by contacting us at hello@kickoffsocialapp.co.uk. Withdrawals are made only to the original payment method used to add the funds, and only in respect of amounts you paid into your Credit balance; Credits arising from a payment that has already been refunded to you cannot be withdrawn a second time. A withdrawal fee of 4% of the amount withdrawn applies, subject to a minimum of £0.50 and a maximum of £2.00. This fee reflects the payment processing charges we incur that are not returned to us when a payment is refunded, together with the cost of administering your request. The minimum withdrawal is £5.00. We aim to review requests within 7 days; once approved, funds typically reach your account within 5 to 10 working days depending on your bank or card provider. Funds added to your balance more than 180 days before your request may not be withdrawable, as our payment processor does not permit refunds after that period; where this applies we will contact you to agree an alternative.

By using the App, you agree not to:

We reserve the right to suspend or terminate your account if you breach these Terms or engage in conduct that we reasonably consider to be harmful to other Users or to the App. Our community expectations are set out further in our Code of Conduct.

10. Intellectual Property

All content, features, and functionality of the App are the exclusive property of Kick Off App Ltd or its licensors and are protected by United Kingdom and international copyright, trademark, and other intellectual property laws. The KickOff name and logo are trademarks of Kick Off App Ltd (UK Trademark Application No. UK00004400232). You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any of the App's content without prior written consent from Kick Off App Ltd.

11. Health Data and Apple HealthKit

The App may request permission to access health and fitness data through Apple HealthKit, including distance walked/run, heart rate, and active energy burned. This data is used to show you your fitness metrics and heatmap for each match, and to work out how far you ran. Health data access is entirely optional and requires your explicit consent through the iOS permissions system. You may revoke this permission at any time through your device's Settings. Health data is stored on our servers so that your statistics and heatmaps are there when you sign in on another device. It is not sold to, shared with, or disclosed to any third parties, and it is not used for advertising, profiling, or to train any model. Heart rate and calorie data are visible only to you and are never shown to other Users. Your average distance per match is also private unless you choose to share it: you may turn on “Show my distance in the league table” in Privacy settings, which adds your average kilometres to the league table your group can see. That setting is off unless you turn it on, and you can turn it off again at any time.

12. Privacy and Data Protection

Kick Off App Ltd is committed to protecting your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Full details of how we collect, use, and protect your data are set out in our Privacy Policy.

13. Limitation of Liability

To the fullest extent permitted by law, Kick Off App Ltd and its directors, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the App. KickOff facilitates the organisation of football matches but does not assume responsibility for any physical injury, property damage, or other harm that may occur during or in connection with a Match. Users participate in Matches at their own risk and are advised to ensure they are physically fit to participate and have appropriate insurance cover. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

14. Disclaimers

The App is provided on an "as is" and "as available" basis. We make no warranties or representations, express or implied, regarding the App's availability, reliability, accuracy, or fitness for a particular purpose. KickOff does not verify the identity, skill level accuracy, or conduct of its Users beyond the information provided during registration and the in-app skills questionnaire. You are responsible for exercising your own judgment when interacting with other Users.

15. Third-Party Services

The App integrates with third-party services to provide its functionality, including Stripe (payment processing), Supabase (authentication), MongoDB Atlas (data storage), Apple HealthKit (optional health data), and Google Maps (venue location). Your use of these third-party services is subject to their respective terms and conditions. Kick Off App Ltd is not responsible for the availability, accuracy, or conduct of any third-party service.

16. Termination

You may delete your account at any time by contacting us. We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or if continued use of the App poses a risk to other Users or to the operation of the App. Upon termination, your right to use the App will immediately cease. Where you close your account, or where we terminate it other than for a breach of these Terms, you may request the return of any unspent Credits in accordance with Section 8 within 90 days of termination.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other appropriate means. Your continued use of the App after such notification constitutes your acceptance of the updated Terms.

18. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.
